STATUTE OF LIMITATIONS IN VAGINAL MESH CASES

The majority of vaginal mesh cases filed in the United States are consolidated in the Southern District of West Virginia in front of the Honorable Joseph Goodwin. The majority of these cases are filed against Boston Scientific, Johnson & Johnson, C.R. Bard, and American Medical Systems. The Naumes Law Group is accepting clients who have been harmed by mesh implanted for pelvic organ prolapse (POP Kits), and stress urinary incontinence (Slings).

Many victims have recently been asking the same two questions related to vaginal mesh implants and the litigation.

The first question is “my doctor told me that my mesh isn’t the mesh that’s on TV.”   Let a Naumes Law Group attorney investigate your claim at no cost to you. We can obtain the implant log and sticker page from your doctor and determine if it is the type of vaginal mesh that is the subject of this litigation.

While the Boston Scientific Pinnacle Pelvic Floor Kit was recalled, many other mesh products were merely discontinued. These products include C.R. Bard’s Avaulta Mesh, and Johnson and Johnson Prolift Products. Many of the bladder slings that are subject of this litigation are still being sold to this day.

The second question women are asking is “My doctor told me the statute of limitations has expired to bring a claim.” Let a Naumes Law Group attorney, not your doctor determine if there is an issue with your statute of limitations.

On November 24, 2014, Judge Goodwin allowed a lawsuit to proceed in West Virginia, when a women experienced pain and complications related to her mesh more than two years prior to her filing a lawsuit. In Bellew v. Ethicon, Inc., et al, (13-CV-22473), Ethicon’s Motion for Summary Judgment based on the Statute of Limitations was denied. Speak to an attorney when deciding to pursue a claim so that you can be aware of all your options.

If you are experiencing pain, erosion, extrusion, or have had a surgery to remove vaginal mesh, please contact the Naumes Law Group to discuss your claim today. We are pursuing claims against Boston Scientific, C.R. Bard, Johnson & Johnson, and American Medical Systems. Often claims can be settled without filing a lawsuit.
